SCOTT'S COMICS TERMS AND CONDITIONS
The policies, terms, and conditions described below, as well as the details on our privacy notice page, and shipping information pages which are included herein by reference, constitute the Conditions of Use for the Scott's Comics web site. By using this web site, or placing of an order, you agree to abide by these Conditions of Use. By using or purchasing anything from this site, you agree that your use is at your sole risk. Scott's Comics will not be liable for any damages of any kind arising from this site or the product sold on the site. Which includes but not limited to direct, indirect, incidental, or consequential damages
Not all items are guaranteed to be in stock when your order is filled. The fill rate is approximately 98%. It is simply impossible to have a database of over 150,000 items and have it be 100% correct. The database can never be perfect and unanticipated outages do occur. You will be properly refunded or credited for any outages. Unless the shortage is more than 20% of your order, you will not be notified first unless you let us know otherwise.
Scott's Comics is not responsible for any damages that you may have for not being able to completely fill an order. Please let us know how you would want to handle any out of stock items when checking out (like contacting you first or cancelling the order).
The item scans on the website are provided to help you identify the item, but is not the specific item being offered, nor does it represent the condition/grade of the item being offered. The item scans are stock scans and are not a scan of the actual item.
If it is the actual item, it will be noted in the description.
HOT COMICS THAT APPRECIATE QUICKLY
Recent TV and movie announcements and appearances have caused some comics to greatly increase in value, sometimes 3-10+ times in just 24 hours. In response to this. Scott's Comics reserves the right to decline orders of books that have quickly appreciated in price. A recent example is the announcement of the Ant Man film that caused Avengers #181 to go up from $4-10 to $30-60 in one day . Think about this in reverse: would you want to sell us a hot comic now worth $30 for only $4? I doubt you would.
Generally this policy is enacted if the the item has gone up at least 3 times its original value. We try to remove these items quickly or adjust the prices when we hear about them, but since this is a part time business, it is sometimes too late before they have been ordered. Scott's Comics apologizes for any inconvenience this may cause, but we want you to understand if you order these types of comics - you will likely not get them. In all cases, you will be refunded any monies paid.
Scott's Comics reserves the right to cancel any order with a complete refund of payment to the customer, if any. Generally, cancelled orders are due to non-payment by the customer (bad credit card, didn't mail payment, bounced check, etc.).
Generally, we do not want to change your order once it has been placed, but are willing to work with you as long as it has not been pulled or shipped. Scott's Comics is not responsible for change requests that are not received prior to shipment. If you want to change or cancel an order that has been pulled (but not shipped) there will be a 10% restocking fee for the unwanted items.
SHIPPING / TURNAROUND TIMES
Scott's Comics basically ships once per week. Most orders received by 5AM Eastern Standard Time Friday ship on Fridays. Some priority mail and foreign orders may ship on Saturday or Monday. If Monday goes by and you have not received notification that your order has shipped, please contact us.
We will deliver all orders to the address you notify to us when you place your order. You agree that we will not be responsible for failure to deliver orders if you have supplied us with an incorrect address. If we receive an incorrectly addressed shipment back from the post office, you will be responsible for paying to reship the package, We reserve the right to dispose of incorrectly addressed orders and their contents with only an 80% refund (minus shipping) to you or any other person if they are returned to us and despite efforts to contact you we do not receive correct address details.
If your order was damaged in transit by the Post Office, save the box and packing materials. We may need it to file a claim.
Your order is important to us. If you are not satisfied, YOU MUST contact email@example.com with your order number with a return authorization before attempting any return. If it is a problem that is our fault (damaged, defective, or incorrect item), we will notify how to return the item(s) if needed. If you return without authorization, you may incur a 15% restocking fee and we will will not reimburse shipping.
To receive prompt credit to your account or a refund to your credit card, please include a copy of the original invoice or some other notations (like an e-mail printout). Including the order number will help also. Otherwise your claim may experience significant delays in processing.
All returns must be shipped in a sturdy box or packed between heavy cardboard. Do not ship back the book to use in a flimsy envelope (like a manila envelope). We will refuse returns not packed well as we will assumed they are damaged. We have had the post office bend the books and stuff them in our post office box!!
LOST/DAMAGED ORDERS. If your order was lost in transit, please let us know as soon as possible. We will credit your account with us, refund you, or reship all or part of the order, as appropriate. Generally we don't consider a shipment "lost" for one month. If the order was damaged, keep the packaging! We may need it to file for insurance on the package; it may be difficult to refund you if we aren't able to process our claim. You must inform us of any damage to your order within three business days of receipt.
OVERGRADED COMICS. If you believe we have overgraded a comic (Comics graded by CGC and PGX are not returnable). Please let us know within 3 business days for guidance. We will credit your account, refund you, or ship the proper item, as appropriate, generally after the item is returned. If we need you to return the book, we will reimburse you for basic ground shipping.
WRONG BOOKS. If we have sent you the wrong book or failed to send a book. Please let us know within three business days of receipt. We will credit your account, refund you, or ship the proper item, as appropriate. If we need you to return the book, we will reimburse you for basic ground shipping.
OTHER REASONS. We only accept returns that are damaged, defective, or incorrect. If there is another reason you want to return, for instance, you don't like the story or art, want a newstand copy instead of direct sales (when they have the same value) or without authorization will incur a 15% restocking fee, deducted from the value of the refund. We will also not reimburse any shipping fees.
The customer represents that he/she is at least eighteen (18) years of age or if under eighteen (18) years of age, the customer is ordering with the express permission of his/her parents or legal guardian. Parents are encouraged to review the content of any items ordered from this website upon delivery. Most comic books are NOT intended for all ages. By placing an order, you hold Scott's Comics harmless for any content found in any of the items.
Please attempt to work out any problems with Scott's Comics before contacting your credit card company or Paypal. Customers that order in bad faith, receive goods, and then claim a chargeback will be charged a $35 fee and turned over to a collection agency.
